SPECIFIC KNOWLEDGE & SKILLS
  • Strong exposure of general litigation with proven track record of high success rate. Comes with a strong background in reducing lead time for resolution of litigation issues and consumer/commercial settlements.
  • Exceptionally good in the legal negotiations such as land acquisitions, change of land use, collaborations, transfer of ownership, tender bidding, and contract acquisitions.
  • Knowledge of all applicable laws especially civil, Land acquisition/RERA and consumer laws.
  • Exposure to corporate restructuring, policy reviews and legal aspects of business restructuring and JV formation.
  • Demonstrates established relationships with leading Counsels and the regulatory bodies such as RERA, NCLT and NCDRC.
ROLES & RESPONSIBILITIES
  • Developing and leading corporate legal team and strategy to promote and protect the company\'s matters.
  • Participate in high value/complex litigations & lead the process of developing adequate case background in such litigations.
  • Defend arbitration matters and all claims against the Company.
  • Oversee and review all critical/ high value/ non-standard legal documentation for all functions such as contracts, negotiate favourable terms during MoUs / divestments/ JVs keeping in mind the company\'s long-term interests to minimize the legal risk associated with any land acquisition, business expansion, disinvestments and enhance risk management controls.
  • Providing legal advice for all commercial transactions such as JDAs pertaining to land monetization or JDAs/DM deals for expansions.
  • Represent the company before various government authorities & regulatory bodies such as collector, Municipal Authorities, Town Planning Authorities.
  • Oversee and review all critical/ high value/ non-standard legal documentation for all functions.
  • Handle land related matters by supervising team on preparing and handling legal cases, briefs, give opinions, formulate strategies and advise on legal matters / acquisition of land for the project.
  • Provide legal advice to the senior leadership on all legal matters affecting their individual departmental transactions.
  • Define legal guidelines for agreements, contracts and other legal documents.
  • Establish process checks and oversee adherence to legal compliance across the organization and ensure policies and processes are compliant with regulatory norms and company guidelines.
  • Responsible for handling legal related interfaces for all customer matters.
  • Conduct legal vetting of all business policies of the organization.
  • Work with departmental leadership across the business in identifying and managing potential legal risks.
THE CANDIDATE
Qualifications and Experience Degree in Law (LLB or higher) from premier institutes/universities.
  • 8-12 years of experience in civil, commercial, litigation and consumer law.
  • Should have worked in a large Real estate Development firm, Law Firms or Large conglomerates participating in Indias real estate sector.
  • Preference for at least 8 years with real estate sector specialization.
