Key Responsibilities:
- Legal Advisory and Compliance:
- Provide legal advice on property transactions, regulatory compliance, and business operations.
- Ensure all real estate transactions comply with local, state, and federal laws.
- Monitor changes in real estate laws and regulations and implement necessary compliance measures.
- Contract Drafting and Review:
- Draft, review, and negotiate contracts, including purchase agreements, leases, joint venture agreements, and vendor contracts.
- Ensure clarity, accuracy, and enforceability of all legal documents related to real estate projects.
- Litigation Management:
- Represent the company in legal disputes related to real estate, including litigation and arbitration.
- Liaise with external legal counsel as necessary for specialized legal matters.
- Due Diligence:
- Conduct and oversee due diligence for property acquisitions, including title searches, zoning reviews, and environmental assessments.
- Identify and mitigate potential risks in real estate transactions.
- Risk Management:
- Develop and implement strategies to mitigate legal and regulatory risks.
- Provide guidance to management on risk factors in proposed business ventures or projects.
- Regulatory Filings and Documentation:
- Ensure timely filing of all necessary documentation with regulatory authorities.
- Maintain an organized system for all legal documentation related to real estate projects.
- Collaboration and Training:
- Work closely with other departments, including sales, finance, and operations, to address legal concerns.
- Train staff on real estate laws, compliance requirements, and contract management.
- Dispute Resolution:
- Manage disputes related to tenant issues, construction contracts, or land use.
- Ensure efficient resolution of disputes to minimize business disruption.
- Land and Title Matters:
- Address and resolve title issues, encumbrances, or disputes over land ownership.
- Verify and secure clear titles for property acquisitions.
Qualifications:
- Bachelors or Master’s degree in Law (LLB or LLM).
- Bar certification or equivalent legal qualification.
- 5+ years of experience in real estate law, property law, or related fields.
- In-depth knowledge of real estate transactions, land use regulations, and contract law.
Skills:
- Strong analytical and problem-solving skills.
- Excellent negotiation and drafting skills.
- Effective communication and stakeholder management.
- Ability to manage multiple priorities in a fast-paced environment.
- Proficiency in legal research tools and software.
